Alternative Dispute Resolution

Scope of Activities

To follow the developments in ADR practice throughout the world and report matters of interest; to participate in WIPO's development of an ADR service for international IP cases; to undertake education via articles and speeches by which to educate Section members with respect to ADR; to recommend resolutions and take such other actions as the developments in the area may suggest.


Antitrust

Scope of Activities

Advises the membership of current developments in the field of antitrust law and trade regulation insofar as they are related to intellectual property law; reviews the statutes, legislation, judicial decisions, treaties, and practices and procedures before the courts and administrative agencies; and recommends resolutions for originating, supporting or opposing positions on current positions and proposed changes.


By-Laws Competition and Trade Secrets Committee

Scope of Activities

Develops a comprehensive understanding of the By-Laws and other procedures applicable to administration of the Section, including regulations and procedures of the State Bar of Texas; advises the Section Officers and Council of procedures; and proposes changes of By-laws or other procedures when requested by the Section Officers, Council or by committee recommendation.


Continuing Legal Education Committee

Scope of Activities

To set agenda for continuing legal education classes.


Convention Arrangements

Scope of Activities

Determines the educational and social activities for the Section during the State Bar Convention. Arranges for facilities, speakers and support needs; coordinates publicity for the Section meeting with the State Bar of Texas; and administers the details of the meeting.


Copyright Committee

Scope of Activities

Seeking Members for IP Section Copyright Committee

As the new chair of the IP Section Copyright Committee, I would like to invite anyone interested in participating on the committee who has not yet contacted me to do so at ghoffmann@fulbright.com. Anyone interested in copyright law is welcome -- you don't need to be an expert in the area or even have a large practice in copyright. Our first task will be to decide what the committee's focus and role should be. One suggestion has been to start a statewide chapter of the Copyright Society of America, but we need your suggestions and input to make this committee a valuable part of the State Bar.


Diversity Task Force

Scope of Activities

The Intellectual Property Law Section of the State Bar of Texas will award two $2,500 scholarships, each to a woman and/or minority law student. Any woman or member of a recognized minority group, including but not limited to African Americans, Hispanics, Asian Americans, and Native Americans who intends to practice IP law in the State of Texas, is eligible to apply. Applicants must be enrolled in an ABA-accredited law school in Texas at the time the application is submitted. Thus, persons who have been accepted to law school but have not yet started classes at the time the application is filed are ineligible. However, persons who have graduated at the time the scholarship is awarded are eligible for the scholarship.

The purpose of this scholarship is to facilitate and encourage women and minorities to enter the practice of intellectual property law in Texas, and to become active members of the State Bar IP Section, by assisting these students with their financial needs. Selection criteria of the scholarships include: merit, scholastic performance, and financial need. Consideration is also given to extracurricular activities both inside and outside law school.

The scholarships will be awarded at the Annual Meeting in Houston on June 27, 2008.


Electronic & Computer Law Committee

Scope of Activities

To advise the membership of current developments in those areas of law relating to electronics and computers; to prepare a periodic update on recent legal developments in these areas; and to consider resolutions that will assist with the orderly future development of law in these areas.


Ethics and Unauthorized Practice Committee

Scope of Activities

monitors the level of professional activities in the practice of intellectual property law and advises the membership; recommends resolutions for changes within the Code of Professional Responsibility; answers questions by the membership and to the Section concerning ethical conduct; reviews the participation of persons in the practice in meeting their professional responsibilities, particularly regarding pro-bono work in cooperation with the lawyer referral service of the State Bar of Texas; and monitors, reports and recommends action, including prosecution, against those engaged in any unauthorized practice of intellectual property law especially the activities of unethical inventor developers and "vanity" publishers.


International Law Committee

Scope of Activities

To address international law aspects of intellectual property.


Inventor's Recognition Committee

Scope of Activities

Annually solicits nominees from the membership and from without of worthy Texas inventors to be honored by the Section; selects and advises the Section Council of one or more inventors the committee recommends to be honored at the State Bar Convention; and prepares the nomination of the previous year’s honored awardee(s) for nomination consideration the subsequent year in the National Inventors Hall of Fame.


Litigation Committee

Scope of Activities

Identify trends in intellectual property litigation areas, with an emphasis on trends uniquely impacting IP litigators in Texas.  Identify views of our members respecting these trends, and advocate change and/or inform the Section, where appropriate.  Prepare articles concerning intellectual property litigation in Texas for publication in the Section’s newsletter.  Facilitate professional relationships among members


Membership Committee

Scope of Activities

Encourages existing members to maintain their Section membership and the growth of the Section by the addition of new members; provides information and assistance regarding employment of prospective employers and employees; and coordinates with the Section Secretary and Treasurer the annual updating, publishing and distribution of the directory of the Intellectual Property Law Section of the State Bar of Texas.


Newsletter Committee

Scope of Activities

Writes, edits, publishes and distributes newsletters to regularly communicate with Section membership regarding relevant news and information.


Nominating Committee

Scope of Activities

Select and prepare a slate of candidates for each of the various offices to be filled at the annual election meeting as prescribed by the By-laws, Article IV, Section 2; and report its selected slate to the Secretary at least thirty (30) days prior to the annual meeting.


Opinions Committee

Scope of Activities

The ABA has published a list of guidelines and issues for consideration when drafting patent opinions of (in)validity and (non)infringement. In particular, the “Proposed Guidelines for Written Opinions on Patent Invalidity/Non-Infringement” from the ABA Section of Intellectual Property Law (Committee No. 651 – Special Committee On Attorneys’ Opinions) is published as part of the 2002-2003 Annual Report, and is available here. While the guidelines are a “work in progress” which the ABA intends to update to reflect the Knorr-Bremse decision and to incorporate new principles of patent law, the guidelines are still a helpful tool for consideration by the practitioner.

Any bar members interested in the intellectual property opinions and best practices regarding same are invited to join the Opinion Committee by contacting either Committee Chair Tom Felgers (tom.felger@bakerbotts.com) or Vice Chair David Ostfield (David.Ostfeld@arlaw.com).


Patent Legislation Committee

Scope of Activities

Monitors the proposed legislation and treaty provisions pertaining to patent law revision and recommend supporting, opposing and amendment resolutions thereto; and initiates resolutions for proposed patent law legislation in view of judicial decision, court and administrative agency practices.


Pro Bono Committee

Scope of Activities

Provide pro bono services to low-income individuals.


Public Relations Committee

Scope of Activities

The purpose of the Public Relations Committee is to educate the public about intellectual property law and to engage in public service activities to further that goal.  The Committee will organize a speaker’s bureau to fulfill requests for speakers on intellectual property law topics to non-lawyers, general lawyers, law students, and schoolchildren in Texas.  The Committee will advise council as to opportunities for the Section to serve the public with respect to education on intellectual property law and other public service activities intended to enhance the image of the section and its members.  The Committee will develop policies on media inquiries from the public to the Section.


Section Website Committee

Scope of Activities

Administers and maintains the section website.


Trademark Committee

Scope of Activities

Advises membership of current legislation, judicial decisions, treaties, practices and procedures before the courts and the Trademark Operations of the PTO; recommends resolutions for supporting, opposing or amending current conditions and proposed changes, including those proposed by other organizations.


Unfair Competition and Trade Secrets Committee

Scope of Activities

Monitors the statutes and judicial decisions relating to unfair competition and trade secrets, and particularly, but without limitation, including protection of trade secrets and other information maintained in confidence, interferences with contractual relations, trade dress confusion, product simulation, trade libel and slander; advises the membership of important developments related to unfair competition and trade secret law; and proposes resolutions for legislative or other action related to unfair competition and trade secret law.


IP Journal Committee

Scope of Activities

The Texas Intellectual Property Law Journal is published jointly by the State Bar of Texas Intellectual Property Law Section and students at the University of Texas School of Law. Established in 1992, the Journal has become one of the premier publications in the intellectual property law field. The Journal is published three times per year, and each issue contains scholarly articles, notes, and news about the Section. Section members receive a subscription to the Journal as part of their membership; others may subscribe by contacting School of Law Publications, Inc., P.O. Box 149084, Austin, Texas 78714-9084.
